What is grooming

Fencing is the operation whereby the boundary between two neighbouring properties is established and marked by visible signs (e.g. by means of a fence).

Fencing can be used both in situations where there is no boundary between two adjoining pieces of land marked by external signs, and in situations where there is some marking but it is a matter of dispute between the owners of the adjoining land.

 

Ways in which grating can be achieved

Engraving can be carried out (i) by the will of the neighbouring owners or (ii) by a court order.

 

Claim action and grafting

Where the need for enclosure arises due to an erroneous location of the fence between the two properties, the owner whose land has been diminished by the removal of the fence is required to bring both an action for a claim in respect of the land he is deprived of and an action for enclosure in order to definitively clarify the boundary.
