Authorisation of company officials

A company comes into existence when it is entered in the commercial register.

The resolution issued by the Trade Register Office authorises the establishment and operation of the future company.

In general, the authorisation of a company’s officers is sufficient for the company to start trading.

However, in certain situations, depending on a number of factors (e.g. the object of activity of the company, the type and/or nature of the business activity, the place where the business activity is carried out, the raw materials used in the course of the business activity, etc.) it is possible that a certain company may be required to obtain certain authorisations/authorisations prior to the start of the business activity (e.g. environmental authorisation, integrated environmental authorisation, medical operating authorisations, certifications, etc.).

According to the legislation, carrying out activities for which the law requires certain prior authorisations is sanctioned with the invalidity of operations carried out without authorisations and/or the application of administrative and/or criminal sanctions.
